Social service professionals see clients with varying degrees of mental capacity. Some may already have had someone appointed by the court to make decisions on their behalf; others may have designated someone to assist with decisions should they become unable to do so independently. Finally, while managing a client’s care, you may come to believe that, in the absence of someone to make crucial medical decisions of behalf of the client, they will become a danger to self or others. This workshop will explore the available legal options of Guardianship and Power of Attorney. We will explore the ethical tension inherent when a client can no longer make their own decisions. Other ethical issues that may arise in treating a client who is no longer competent or may be a danger to himself or others will also be discussed.

This is an in-person workshop that will be held on Washington University’s Danforth Campus. The exact location and directions will be emailed to registered participants before the course date.

This class meets the licensure requirement for 3 hours of continuing education in ethics.

Course Outline

Content Level: Beginner

Target Audiences: Social workers, therapists and/or other mental health providers.

Agenda:

  • 9:30-10:30 – Review the social work code of ethics related to client competency and when an
  • individual may be a danger to themselves or others. Review Missouri law requirements on powers of attorney and guardianships as well as the capacity needed for each option.
  • 10:30-11:30 – Participants will roleplay scenarios and discuss their decisions in regards to application of the code of ethics and Missouri statutes.
  • 11:30-12:30 Participants will through small group role play scenarios determine whether to:
    • Take no action
    • Recommend the client seek out legal advice to execute durable powers of attorney for financial and healthcare assistance
    • Complete an affidavit for a 96-hour detention
    • Initiate a 96-hour detention
    • Talk with the client’s family about guardianship
    • Complete a medical affidavit recommending a partial or full guardianship

*A 5-minute break will occur approximately halfway through the workshop.

Learner Outcomes

  • Learners will interpret the social work code of ethics and Missouri statutes for determination of when an individual is at risk to themselves or others and/or whether an individual is in need of additional assistance to meet their activities of daily living.
  • Learners will demonstrate skills to engage a client who may be a danger to themselves or others to evaluate their ethical and statutory duties to clients and the public.
  • Learners will describe the statutory framework for when a guardianship is necessary as well as how to appropriately summarize the information necessary for the judicial officers to make an informed decision about whether a guardianship is needed or a lesser restrictive alternative is a viable option.

Course Completion Requirements:

  • The Brown School, Washington University in St. Louis, Professional Development, provider #2130, is approved as an ACE provider to offer social work continuing education by the Association of Social Work Boards (ASWB) Approved Continuing Education (ACE) program. Regulatory boards are the final authority on courses accepted for continuing education credit. ACE provider approval period: 9/24/2024 – 9/24/2025. Social workers completing this course receive 3 ethics continuing education credits.
  • The Brown School is also an approved provider of Social Work CEs in Missouri and Illinois.
  • To earn ACE credit, attendees must arrive at the scheduled time, attend the entire course, and complete an online course evaluation. ACE credit is not provided for partial attendance.  However, you may still qualify for partial Social Work Missouri and Illinois CEs provided by the Brown School.
  • Brown School CE Certificates will be available online within 10 business days of course completion by visiting your learner profile at https://ce.wustl.edu/portal/logon.do?method=load&parentSite=brown.  You will receive an email notification with specific instructions for accessing the online certificate when it is available. ACE CE Certificates, if requested in your evaluation survey, will be emailed within 10 business days of course completion.
